INTRODUCTION
These conditions apply to all sales concluded with SARL MENKAS located at 60, rue des Buttes 60600 Agnetz (with the exception of group bookings). The customer hereby acknowledges having read these general terms and conditions of sale and undertakes to respect them.
These conditions of sale may be modified at any time, and the conditions applicable will be those in force on the date the reservation is made.

ARTICLE 1 - PRICES
Prices are quoted in euros (€) and include VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically passed on to the prices indicated on the date of invoicing.
Rates are per room for the number of people indicated and according to the period selected and do not include services (unless otherwise stated).
The establishment is exempt from tourist tax.
Certain services may be subject to a supplement and may be subject to change without prior notice, for which the hotel cannot be held responsible.
No stay booked before the introduction of any promotional offer will be reimbursed, even partially.

ARTICLE 2 - BOOKING AND MEANS OF PAYMENT
Reservations can be made on the www.clermotel.fr website, by telephone, e-mail or post.
Reservations will only be confirmed if they are guaranteed by the customer, either by providing a credit card number with its validity date or by transferring a deposit, and after receiving detailed confirmation of the reservation.
Payment for all services must be made directly to the establishment. (Exception made for bookings prepaid at the time of booking or non-cancellable, non-refundable).
The establishment reserves the right to refuse any reservation if the credit card number is incorrect, the reservation incomplete or for any other reason(s).
Reservations from all sources are payable in euros (€) only.
SARL MENKAS accepts the following credit cards: Visa, Mastercard and American Express and has a secure reservation system (SSL) which protects and encrypts all sensitive data transmitted to the reservation in order to prevent any disclosure to a third party.
At the time of booking, the credit card will be authorised to be debited. This will be for information purposes only, and will under no circumstances be a debit to the account except in the following cases:
- Promotional offer with the words ‘non-cancellable non-refundable’.
- If the validity date of the credit card is earlier than the date of arrival.
- If the arrival date is more than 60 days after the booking date, unless otherwise stated.
The customer is solely responsible for their choice of services and their suitability for their needs, and SARL MENKAS cannot be held liable in this respect.

ARTICLE 3 - FORCE MAJEURE
Force majeure is any event outside the control of the parties that is both unforeseeable and insurmountable, and which prevents the customer from performing all or part of the obligations set out in the contract during the trip, subject only to written justification.
ARTICLE 4 - CHANGES AND CANCELLATIONS
Any modification or cancellation of a booking must be requested by email to info@clermotel.fr or by telephone on 03.44.50.09.90.
The request will only become effective once SARL MENKAS has confirmed its acceptance in writing.
In the event of modification or cancellation of a holiday, the following conditions apply (except in cases of force majeure):
- For any request made less than forty-eight hours before the planned date of arrival, the amount of the first night will be invoiced, and if your reservation is part of a promotion, the entire stay will be due.
- If you fail to arrive within 22 hours of the scheduled arrival date, your credit card will be charged for the first night.
- Any stay commenced is payable in full.
For bookings made via our partners' websites, cancellations must be made via this website. The cancellation conditions that apply are specific to the partner and may therefore differ from those of SARL MENKAS.
In the event of an extended stay, the customer must inform the hotel reception by 10 a.m. on the day of departure at the latest, in order to check availability.
The request will only become effective once SARL MENKAS has confirmed its acceptance in writing.

Rooms are available from 3pm and must be vacated by 11.30am on the day of departure. A supplement may be charged if the maximum check-out time is not respected. In the event of arrival after 8 p.m., reception must be notified.
The customer accepts and undertakes to use the room in a responsible manner. Any behaviour contrary to good morals and public order will lead SARL MENKAS to ask the customer to leave the establishment without any compensation or refund.
The customer undertakes not to smoke or vapourise in the rooms. If traces, odours or evidence of tobacco are found, an additional night will be automatically invoiced due to disinfection and the inability of SARL MENKAS to re-let the room for a minimum of twenty-four hours.

ARTICLE 6 - RELOCATION
In the event of SARL MENKAS being unavailable or in the event of force majeure, the latter reserves the right to accommodate the customer in whole or in part in a hotel offering services of the same nature.

ARTICLE 7 - CLAIMS AND LITIGATION
All complaints must be sent to SARL MENKAS by registered letter with return receipt, within 15 days of the departure of the holiday that is the subject of the said complaint. After this period, no complaint will be taken into account.
After having referred the matter to the management of the establishment and in the absence of a satisfactory response within a period of one month, the customer may refer the matter to the Médiateur du Tourisme et du Voyage (Tourism and Travel Ombudsman), whose contact details and procedures are available on its website www.mtv.travel or by post at Médiation Tourisme Voyage - BP 80303 - 75823 PARIS CEDEX 17.

ARTICLE 8 - INFORMATION TECHNOLOGY AND CIVIL LIBERTIES
In application of the French Data Protection Act 78-17, customers are informed that their reservation is subject to computerised personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the head office: SARL MENKAS, 60, rue des Buttes, 60600 Agnetz. It is specified that this information is not communicated to third parties.
The customer acknowledges that the information communicated at the time of booking may be processed for statistical and marketing purposes, in particular for non-targeted commercial operations.
SARL MENKAS offers wifi internet access. The client user undertakes to ensure that the computer resources made available are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright, by a related right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code when such authorisation is required.
SARL MENKAS has a video surveillance system in the common areas of the building.
The customer acknowledges that the information communicated at the time of booking may be processed for statistical and marketing purposes, in particular for non-targeted commercial operations.

ARTICLE 9 - LIABILITY
The hotel declines all responsibility in the event of theft, loss or damage to guests' belongings during their stay.
The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom he/she is responsible, to movable, decorative and immovable property belonging or not belonging to the hotel. As a result, SARL MENKAS may ask the customer to leave the establishment without any compensation or reimbursement for the stay in progress, and to reimburse any damage caused by these acts.
In the event of damage, a complaint will systematically be lodged with the public prosecutor, and the amount of damage found will be invoiced.
The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom he/she is responsible, to movable, decorative and immovable property belonging or not belonging to the hotel. As a result, SARL MENKAS may ask the customer to leave the establishment without any compensation or reimbursement for the stay in progress, and to reimburse any damage caused by these acts.

ARTICLE 10 - BRAND IMAGE AND INTELLECTUAL PROPERTY
SARL MENKAS authorises the Customer to take photographs and videos in the public areas of the establishment and those on a private basis. Any dissemination by any means whatsoever, present or future, must be made using the commercial name of SARL MENKAS, i.e. ‘Logis Clermotel’ or ‘Clermotel’ or ‘LUCAS Restaurant’.
In the event of distribution for commercial or professional purposes, the customer must contact the owner of the ‘Clermotel’ brand, i.e. SARL MENKAS at 60, Rue des Buttes, 60600 Agnetz, by post in order to establish the distribution terms and conditions. Or by e-mail to pro@clermotel.fr
At the time of booking, the customer acknowledges that he/she is acting in good faith, and has come without any intention of damaging the image of the establishment. The customer also acknowledges that any comments or opinions left on social media or any other Clermotel medium may be used anonymously for commercial purposes.

ARTICLE 11 - APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and formal rules. Any disputes will fall within the exclusive jurisdiction of the French courts.
